If the top of the fender is rusted then the reinforcing piece below 
the top of the fender is also rusted. The other pieces that hold the 
fender to the wheel well are probably also rusted.

The major issue is likely to be the triangular box area between the 
left wheel well and the fuse box and the right wheel well and glove 
compartment. The fender needs to be removed to fix these problems. 
You can remove the plate at the back of the fender well to inspect 
these areas. You can also look under the dashboard for signs of rust through.

I bought all new replacement parts from the local BMW dealer to fix 
mine. That was 20 years ago though. I did all of the repairs myself 
in my garage at home.
